These Terms of Service (“Terms”) govern your use of the Wildd Photography website and the purchase of any services or products.
By accessing this website or making a booking or purchase, you agree to these Terms. If you do not agree, you must not use this website or services.
Nothing in these Terms excludes, restricts or modifies rights under Australian Consumer Law.
1. Business Information
Wildd Photography operates in Sydney, New South Wales, Australia.

2. Eligibility
You must be at least 18 years old to book a session or purchase services unless booking on behalf of a minor as a parent or legal guardian.
By making a booking, you confirm you have legal capacity to enter into a binding agreement.
3. Services Provided
Wildd Photography provides photography services including but not limited to:

Digital image delivery

Albums and printed products
All services are subject to availability and written confirmation.
4. Bookings & Payment
A booking is not confirmed until:

A required deposit has been paid, and
-
Written confirmation has been issued.
Pricing is listed in Australian Dollars (AUD) and includes GST where applicable.
Wildd Photography reserves the right to:

Refuse service
-
Cancel bookings
-
Correct pricing errors
-
Update pricing without notice (existing bookings unaffected)
Full payment terms are governed by the Refund & Cancellation Policy.
5. Accuracy of Information
While we take reasonable care to ensure website information is accurate, we do not warrant that descriptions, pricing, availability, or other content is error-free.
We reserve the right to correct errors at any time.
6. Intellectual Property
All website content, including:

Logos
-

Branding

Graphics
is the intellectual property of Wildd Photography and may not be copied, reproduced, distributed, or used without written consent.
Copyright in all photographs remains with Wildd Photography unless otherwise agreed in writing.
Clients receive a license to use delivered images for personal use only unless a commercial license is purchased.
7. Client Conduct
Clients agree to conduct themselves in a respectful, lawful, and cooperative manner at all times before, during, and after their session.
By booking a session, clients acknowledge and agree to the following:
7.1 Respectful Behaviour
Clients must not engage in:

Abusive, threatening, aggressive, or discriminatory behaviour

Harassment (verbal, physical, or online)

Intimidation or coercion of staff

Sexual harassment or inappropriate conduct
-
Defamatory or knowingly false public statements
Wildd Photography reserves the right to immediately terminate a session without refund if such behavior occurs.
7.2 Safety & Studio Environment
Clients must:

Follow all safety instructions provided
-
Respect studio equipment and property
-
Not interfere with lighting, backdrops, or equipment
-
Supervise any children they bring
-
Ensure guests behave appropriately
Wildd Photography may refuse entry to additional guests if space or safety is compromised.
Any damage caused by a client or their guest may result in a charge for repair or replacement costs.
7.3 Punctuality
Clients must arrive on time for scheduled sessions.
Late arrival may result in:

Reduced session time
-
Modification of the session structure
-
Cancellation if the delay exceeds 20 minutes
Session end times will not be extended due to late arrival.
7.4 Social Media Conduct
Clients agree not to:

Publicly post misleading, defamatory, or malicious statements

Edit delivered images in a way that misrepresents the photographer’s work

Apply heavy filters or alterations without credit or permission
-
Use images commercially without a commercial license
7.5 Cooperation During Session
Clients acknowledge that:

Photography results depend on cooperation, communication, and participation
-
Refusal to follow direction may affect outcomes
-
Personal appearance, styling choices, or posing preferences remain the responsibility of the client
Subjective dissatisfaction with appearance does not constitute a service failure.
7.6 Termination of Services
Wildd Photography reserves the right to terminate services without refund where:

Client conduct creates an unsafe environment
-
Equipment or property is placed at risk
-
Staff wellbeing is compromised
-
The session cannot reasonably proceed
Termination under this clause does not waive the right to pursue recovery of damages where applicable
8. Third-Party Services
Our website is hosted via Shopify and may integrate third-party providers including payment processors, booking systems, and gallery platforms.
Wildd Photography is not responsible for the policies or practices of third-party services.
Use of third-party services is subject to their own terms and privacy policies.
9. Limitation of Liability
To the maximum extent permitted by law:

Wildd Photography’s liability is limited to the amount paid for the relevant service.

We are not liable for indirect, incidental, or consequential damages, including loss of income or emotional distress.
Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.
10. Force Majeure
Wildd Photography is not liable for delay or failure to perform due to events beyond reasonable control, including illness, government restrictions, venue closures, natural disasters, severe weather, third-party cancellations or equipment failure.
In such cases, remedies will be provided in accordance with our Refund & Cancellation Policy.
11. Privacy
Your use of our website and services is governed by our Privacy Policy.
By using this website, you consent to the collection and use of personal information as described in that policy.
12. Refunds & Cancellations
Refunds, cancellations, and rescheduling are governed by our separate Refund & Chargeback Policy.
By making a booking, you acknowledge that you have read and agree to that policy.
13. Chargebacks & Disputes
You agree to contact Wildd Photography directly to resolve concerns before initiating any payment dispute or chargeback.
We reserve the right to dispute fraudulent chargebacks and recover associated costs where permitted by law.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
15. Amendments
Wildd Photography may update these Terms at any time. The current version will always be published on the website.
Continued use of the website constitutes acceptance of any changes.
